1. Agreement to Terms

By creating an account or accessing the virtual number and SMS verification services provided by SMS-OTPS ("we," "us," or "our"), you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SMS-OTPS. If you do not agree to all of these Terms, you must immediately discontinue use of our services.

These Terms apply to all visitors, users, and others who access or use the SMS-OTPS website, APIs, dashboard, and virtual number infrastructure.

2. Account Registration & Security

To access SMS-OTPS services, you must register for an account. By registering, you agree that:

Age Requirement: You must be at least 18 years of age and represent that you have the full legal capacity to enter into this agreement.
You must provide accurate, current, and complete information during registration.
You are solely responsible for maintaining the confidentiality of your account credentials and API keys.
You must not share your account, API keys, or virtual number access with unauthorized third parties.
You agree to notify us immediately at support@smsotps.com of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that breach registration requirements (e.g., creating duplicate accounts to abuse promotions).
One account per person is permitted. Duplicate accounts created to circumvent bans or exploit balance bonuses will be terminated with forfeiture of all funds.

3. Acceptable Use Policy

SMS-OTPS provides temporary virtual phone numbers exclusively for legitimate online SMS verification purposes — such as registering for apps, websites, and digital services where you prefer not to use your personal phone number. You strictly agree not to use our services for:

Engaging in fraud, identity theft, impersonation, account takeovers, or any illegal activity.
Creating fake accounts, spam profiles, or bots on third-party platforms at scale.
Receiving SMS for phishing, credential stuffing, unauthorized 2FA bypass, or financial account takeovers.
Bypassing security controls on financial institutions, healthcare providers, or government services without lawful authorization.
Distributing malicious software, phishing links, or unsolicited bulk communications.
Re-selling or sub-licensing access to our virtual numbers to third parties without prior written approval.
Engaging in activities that violate the intellectual property rights or terms of service of any third party.
Any purpose prohibited under applicable local, national, or international law.

Violation of this Acceptable Use Policy will result in immediate account suspension, forfeiture of remaining balance, and may result in legal reporting to appropriate authorities where applicable.

4. Adding Balance & Deposits

By making a deposit or adding balance to your SMS-OTPS account via any supported payment method (including Cryptocurrencies via Cryptomus, Stripe, etc.), you agree to the following terms:

No Refunds & No Withdrawals: All balance deposits are final. Under no circumstances can added funds be withdrawn back to your personal payment method or refunded to your external accounts.

Funds credited to your SMS-OTPS balance must be used exclusively to order virtual numbers on our platform.
Deposits represent final purchases of platform credit. Balance cannot be converted back to fiat or crypto assets.
All prices are displayed in USD. Exchange rate variations apply to crypto payments.
We reserve the right to adjust pricing with reasonable advance notice to active users.

5. Peer-to-Peer (P2P) Balance Transfers

Peer-to-peer balance transfers allow users to send a portion of their platform balance directly to other registered SMS-OTPS accounts. By initiating a transfer, you agree that:

Completely Irreversible: All P2P balance transfers are processed immediately in real-time. Once completed, they are strictly final and cannot be disputed, recalled, reversed, or refunded under any circumstances.

A standard 0.5% transaction processing fee is assessed to the sender for every balance transfer.
The maximum accumulated limit for P2P transfers is capped at $500.00 USD per day.
You represent that you have carefully verified the recipient's registered email address. Transferred balance sent to the wrong recipient cannot be retrieved.

6. Virtual Numbers & SMS Operations

When you lease or purchase virtual numbers to receive SMS verification codes on SMS-OTPS, you agree to the following terms:

Cancellation Refunds

If you request to cancel an active order before an SMS verification code is received, the lease amount will be automatically and fully refunded back to your SMS-OTPS platform balance.

No Expiration Refunds

Once an ordered virtual number has officially reached its timeout state or expired, the lease is complete and is strictly non-refundable.

Refunds for unsuccessful order processes are only processed back as SMS-OTPS store credit.
Expired virtual numbers are permanently released back to our wholesale carriers — no retrieval or refund can be processed after expiry.
SMS-OTPS does not guarantee that a specific third-party platform (e.g., WhatsApp, Telegram, Google, etc.) will accept our virtual numbers. All trademarks belong to their respective owners.

7. Google OAuth & Third-Party Login

SMS-OTPS offers optional account registration and login via Google OAuth (Google Sign-In). When you choose to sign in with Google, you authorize us to receive the following information from Google's API solely for the purpose of creating and maintaining your SMS-OTPS account:

Email address — used to create and uniquely identify your SMS-OTPS account.
Display name — used to personalise your dashboard profile.

We do not access, collect, or store any other Google account data including Gmail messages, Google Drive files, contacts, calendar events, or any other private Google services. Your Google OAuth token is used only for authentication and is never shared with third parties for marketing or any other purpose.

You may revoke SMS-OTPS access to your Google account at any time through your Google Account permissions settings. Revoking access will not delete your SMS-OTPS account but will disable Google Sign-In for future logins.

8. Intellectual Property

All content, trademarks, logos, software code, designs, API documentation, and intellectual property on the SMS-OTPS platform are the exclusive property of SMS-OTPS and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or content without our prior written consent.

9. Disclaimer of Warranties & Service Availability

Our services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. While we strive to maintain high platform uptime, we make no guarantees regarding uninterrupted service availability, speed, or compatibility with specific third-party platforms.

No Guarantee of Acceptance: Virtual numbers provided by SMS-OTPS may not be accepted by all platforms at all times. Specific third-party platforms (including Google, Meta, WhatsApp, Telegram, Microsoft, Apple, etc.) may block or reject virtual numbers, and we do not guarantee SMS delivery or registration success on any third-party platform.

Number Availability: Virtual number availability depends on our wholesale carrier inventory and may vary by country or service. We do not guarantee the availability of any specific country or service combination at all times.

10. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall SMS-OTPS, its operators, directors, employees, or affiliates be liable for any direct, indirect, incidental, special, punitive, or consequential damages — including but not limited to lost profits, failed verifications, account bans on third-party platforms, or business interruption — resulting from your use of or inability to use our services.

Our total aggregate liability to you for any claim arising under these Terms shall be strictly capped at the amount you paid us for the services in the 30 days preceding the claim.

Indemnification: You agree to defend, indemnify, and hold harmless SMS-OTPS, its operators, affiliates, directors, and employees against any third-party claims, legal actions, losses, damages, liabilities, and legal costs (including reasonable attorney fees) arising from your misuse of the service, violation of these Terms, or your unlawful conduct.

11. Termination of Service

We reserve the right to suspend or terminate your access to SMS-OTPS at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of our infrastructure. Upon termination for violations, any remaining balance is forfeited and is strictly non-refundable.

You may request account deletion at any time by contacting support. Upon account deletion, all associated virtual number history and personal data will be permanently removed within 30 days, except for transaction records required for legal and financial auditing.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes arising out of or relating to these Terms or the use of our services shall be resolved through binding arbitration or, where arbitration is not available, in a court of competent jurisdiction. You agree to waive your right to participate in any class-action lawsuits against SMS-OTPS.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted directly to this page with a revised "Last Updated" date. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to periodically review this page to stay informed of any updates.
